Module 4
Deputyship & Application Hub
Two different orders, two different pathways. Work out which one you need, then follow the steps in order — ticking as you go.
Property & Financial Affairs
The most commonly granted deputyship. It lets you pay bills, manage benefits, deal with a tenancy or property and run P's bank account. You must keep P's money entirely separate from your own and file an annual report to the Office of the Public Guardian.
Security bond estimator
Every property and finance deputy must buy a before the order takes effect. The court sets the bond level; the premium is paid from P's funds each year.
- • The bond protects P if a deputy mismanages their money.
- • You cannot act until the bond is in place — chase it, orders get held up here.
- • Ask the OPG to vary the bond if P's assets rise or fall significantly.

- • Keep a complete copy of everything you send, in date order.
- • Put the case number on every page once you have one.
- • Regional hearings can be listed at your nearest suitable court.
Emergency & out of hours
For genuinely urgent applications — a life-sustaining treatment decision or an imminent move — the Court of Protection has an urgent applications process, and there is an out-of-hours duty judge accessed through the Royal Courts of Justice.
- • Ring the Court of Protection urgent applications line in working hours.
- • Out of hours, the RCJ security desk connects urgent applications to the duty judge — normally a solicitor or counsel makes that call.
- • Have ready: P's initials and date of birth, the decision needed, the clinical position, and why it cannot wait until the next working day.
- • If the risk is abuse or neglect rather than a court decision, call the local authority Emergency Duty Team — or 999.
